The ACC did quickly disclose to Florida Attorney General Ashley Moody what she calls the conference’s” mysterious press freedom deals”, including with ESPN.
Moody filed a lawsuit against the ACC in April supposedly for breaking the Florida Public Records Act. Moody’s lawsuit stems from Florida State’s legal struggle with the ACC over FSU’s desire to leave the event. FSU and Bossy subject to the ACC’s request to “pay and shed more than a half-billion bucks” in charges and penalties for allegedly refusing to turn over media rights agreements that affect a school’s ability to leave the meeting financially.
Although the ACC is a private institution and its advertising deals are negotiated with secret press companies, the league’s membership includes open universities—such as Florida State—along with private universities. Because the contracts pertain to “matters of public concern,” according to Moorey, they are public records for purposes of state law because they were obtained by public entity agents ( the ACC ) acting on behalf of a public entity ( FSU and other public schools ).
Moody’s company claims that the ACC has only permitted in-person viewing of the documents in the presence of a” transporter” at the convention offices in North Carolina. This technique, Moody’s business protests, has compelled FSU leaders to” travel hundreds of miles” and face” thousands of dollars of public cash” expenses.
The ACC will have until Aug. 1 to turn over to Moody copies of: 2010 ACC Multi-Media Agreement, 2012 Amendment and Extension Agreement, 2014 Second Amendment to Multi-Media Agreement, 2016 Amended and Restated ACC-ESPN Multimedia Agreement, ACC-ESPN Network Agreement ( 2016 ), and Letter Amendment to Amended and Restated Multi-Media Agreement ( Aug. 10, 2021 ).
Whether the community sees these treaties, or at least deleted variations of them, remains to be seen. The Moody and the ACC have reached an agreement regarding the level of common exposure. Florida exempts certain categories of personal information from disclosure obligations, just like people records laws in different states.
In North Carolina and Florida, the ACC and Florida State are suing one another. The cases simmer down to acceptable circumstances where Florida State may leave the ACC and the associated legal sanctions for doing so, with FSU even claiming that the ACC mismanaged media rights negotiations. The cases may be settled through a lawsuit that would lead to Florida State leaving the ACC and joining a new strength conference.
